These Terms of Service contain important legal rights and obligations. WetRentals strongly encourages all users to:

Legal Review Period: If you need time to review these Terms with legal counsel before completing a booking, WetRentals will hold your booking for up to five (5) business days at no additional charge. To request this hold, contact support@wetrentals.com with "Legal Review Hold Request" in the subject line immediately after initiating your booking.
Binding Agreement: By creating an account, making a booking, or using our Services, you are entering into a legally binding contract. If you do not agree to these Terms, you are not authorized to use WetRentals Services.
Arbitration Notice: These Terms contain a mandatory arbitration clause (Section 3.0) that affects your legal rights, including your right to file a lawsuit in court and to have a jury trial. You have 14 days to opt out of arbitration by following the instructions in Section 3.0.

Platform Basics

WetRentals is a venue only - We connect boat owners (Hosts) with renters (Renters). We are NOT a party to your rental agreement.

Age requirement: You must be at least 18 years old to use our Services.

Account responsibility: You're responsible for all activity on your account. Keep your login secure.

By signing up, you agree to all Terms of Service. If you don't agree, you cannot use our Services.
Financial Terms
-
Service fees: 10% fee charged to both Renters and Hosts on all bookings.
-
Damage deposits: We may hold and collect damage deposits, which could exceed the amount listed in the rental.
-
Payment processing: All payments must go through WetRentals - direct payments between users are strictly prohibited.
-
Cancellation fees apply based on timing and Host's cancellation policy (Flexible, Moderate, or Strict).
-
Transaction fees are non-refundable in all circumstances.
-
Currency conversion fee: 3% fee applies to all currency conversions.
Safety & Liability - CRITICAL
-
Boating involves serious risks including drowning, serious injury, or death. You voluntarily assume ALL risks.
-
You waive claims against WetRentals for injuries, death, or property damage arising from boating activities.
-
WetRentals has NO liability for accidents, injuries, or damages during your rental - even if caused by negligence.
-
No supervision provided - There are no lifeguards, safety personnel, or WetRentals representatives during rentals.
-
You're responsible for ensuring you and all guests are physically capable and properly skilled for boating.
-
Return boats in same condition as received or face damage charges and potential legal action.
Rules & Restrictions
-
No alcohol/drugs while operating - Zero tolerance policy. Violation results in immediate rental termination and possible legal consequences.
-
Never exceed capacity limits - Serious safety violation with severe penalties including criminal charges.
-
No commercial use - Personal, recreational use only unless specifically approved.
-
No modifications to vessels - You cannot alter, add to, or modify any boat or equipment.
-
No subleasing - You must be present during the entire rental period.
-
Contact info sharing prohibited - Do not share email, phone, or other contact information to circumvent platform.
Coverage Options (All Optional)

AquaShield: 15% of booking - covers superficial damages up to $5,000 ($1,000 deductible)
-
AquaTow: 10% of booking - covers towing/breakdown assistance up to $2,000 ($100 deductible)
-
Loss of Rental Income: 8.5% of booking - covers Host's lost income up to $10,000
Important Policies
-
Arbitration required: Disputes must be resolved through binding arbitration, not court. You waive your right to jury trial and class actions. You can opt out within 14 days by emailing support@wetrentals.com.

Seasonal operations: Platform closed to standard users October 1 - May 1 (Partner Program members excluded).
-
Background checks: We conduct identity verification and may perform background checks on all users.
-
Emergency contacts required: Must provide emergency contact information before booking.
-
Capacity limits strictly enforced: Never exceed the vessel's posted passenger or weight capacity.
Your Responsibilities
-
Ensure you're qualified to operate the vessel and legally authorized in your jurisdiction. Inspect safety equipment before departure and report any issues immediately.

Follow all laws including boating regulations, wildlife protection, and environmental rules.
-
Report incidents immediately - Within 1 hour or as soon as phone service is available.
-
Maintain adequate insurance - Our optional coverage is not a substitute for proper insurance.
-
Secure your belongings - WetRentals has no liability for lost or stolen personal property.
-
Medical fitness - Consult your doctor if you have medical conditions that could affect safe participation.
High-Risk Activities By participating in these activities, you accept additional risk:

Swimming, snorkeling, diving - No supervision or lifeguards provided
-
Water sports (skiing, wakeboarding, tubing) - High risk of serious injury or death
-
Towing activities - May require additional waivers
-
Wildlife encounters - Marine life can be dangerous; maintain safe distances
Geographic & Operational Limits
-
Offshore limits apply: Typically 3-20 nautical miles depending on vessel size
-
Restricted waters: Military zones, marine sanctuaries, international waters (without permission)
-
Weather cancellations: Either party may cancel due to unsafe conditions per force majeure clause
Data & Privacy
-
Data breach notification: Within 72 hours if your information is compromised
-
Account deletion available: Request via email; processed within 30 days
-
Data retention: Transaction records kept for 7 years per financial regulations
-
Photos/videos: By using Services, you grant WetRentals rights to use media for marketing
Dispute Resolution

Damage claims investigated within 14 days with opportunity to respond

Payment disputes resolved within 21 days
-
Report disputes within 14 days or waive your right to dispute

WetRentals may mediate but has no obligation to resolve user-to-user disputes

Arbitration timelines: 60-120 days for hearing, 30 days for decision
Content & Conduct

No hate speech, harassment, or illegal content - Immediate removal and possible account termination

Reviews must be genuine - No fake reviews or manipulation

Accurate listings required - Photos must represent actual vessel

Report violations within the platform - Investigated within 5 business days
What WetRentals Does NOT Provide

Legal Terms

1.0 Your Relationship with WetRentals
Your use of WetRentals products, software, services, website and any mobile applications (collectively "Services") is subject to the terms of this Terms of Service Agreement (this "Agreement"). WetRentals means 12265621 Canada Inc. dba WetRentals (herein referred to as "WetRentals," "us," "we," or "our"). If you are using the Services on behalf of a corporation or other legal entity, "you" means the entity, and the user is warranting that he or she has the rights to bind the entity. By using the Services, you are agreeing to and are subject to the following terms and conditions, as well as our Privacy Policy, herein incorporated by reference (collectively, the "Terms"). If you do not agree to all of the Terms you are not authorized to use WetRentals Services.
You accept the Terms by: (i) clicking the signup button on the creation of your account; or, (ii) by actually using the Services. In the case of (ii), you understand and agree that WetRentals treats your use of the Services as acceptance of the Terms from that point onward.
WetRentals reserves the right, at its discretion, to change, modify, add or remove any of the Terms, in whole or in part, at any time. Please check the Services and the Terms periodically for changes. Your use of the Services after such modified Terms are posted will mean that you accept such Terms.
WETRENTALS IS A VENUE AND IS NOT A PARTY TO ANY RENTAL AGREEMENT OR OTHER TRANSACTION BETWEEN USERS OF THE SERVICES.
WetRentals is Only a Venue. WetRentals acts as a venue for users of the Services as renters ("Renters") and boat owners ("Hosts") (Hosts and Renters, each a "User" and together, "Users") to view and post available boats to facilitate the rental of such boats. WetRentals is not a party to any actual agreement or transaction between Renters and Hosts even though we may from time to time provide tools that relate to a booking, such as a tool to enable a Renter to enter into a transaction to rent a specific boat directly from a Host and payment services to facilitate the booking. As a result, WetRentals has no control over the accuracy or correctness of the content or information provided or used by such Renters and Hosts. Any part of an actual or potential transaction between a Renter and a Host, including the condition, quality, safety or legality of the boats advertised, the truth or accuracy of the listings (including the content thereof or any review related thereto), the ability of Hosts to rent a boat to a Renter, or the ability of Renters to pay for or operate boat rentals are solely the responsibility of each User. Host acknowledges and agrees that Host is solely responsible for the compliance and safety of the Renter(s) who rent Host's boat(s).
You acknowledge and agree to take all reasonable precautions in ensuring the accuracy and reliability of any User-generated content. We are also not responsible for the condition of any boats listed on the Services or the compliance with laws, rules or regulations that may be applicable to boat operation, maintenance, rental or charter in any jurisdiction. As between WetRentals and Hosts, Host acknowledges and agrees that Host is solely responsible for ensuring compliance with laws, rules or regulations that may be applicable to boat operation, maintenance, rental or charter in the jurisdiction in which Host operates or is otherwise located. Renters should satisfy themselves that any boat rented complies with any legal or safety requirements for such rental, and Renters and Hosts have exclusive responsibility for such compliance. Without limiting the foregoing, Hosts and Renters are solely responsible for their own compliance with any legal and/or safety requirements in place in your applicable jurisdiction in light of applicable health and/or travel advisories. Hosts are responsible for determining if renting a boat is permissible and, if so, for providing their boat in sanitary condition for Renters and with appropriate sanitation supplies for Renters to clean the boat after use. Renters are responsible for returning any rented boat in sanitary condition using the sanitation supplies provided by the Host.
Separate Agreements. Users acknowledge and agree that you will be required to enter into a separate agreement and/or waiver, directly between the Renter and Host, prior to making a booking or purchasing a product or service and such agreement and/or waiver may place additional restrictions on your booking, product, or service. Any separate agreements and/or waivers relating to the rental of a boat or related products or services are under the sole control of any Host or provider and Renter.
Release and Indemnity. IN THE EVENT OF A DISPUTE BETWEEN A RENTER AND A HOST, HOST AND RENTER, JOINTLY AND SEVERALLY, HEREBY AGREE TO INDEMNIFY, RELEASE, DEFEND AND HOLD HARMLESS WETRENTALS AND ITS DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES (COLLECTIVELY, THE “WETRENTALS PARTIES”) FROM ANY CLAIMS, CAUSES OF ACTION, DEMANDS, RECOVERIES, LOSSES, DAMAGES (ACTUAL AND CONSEQUENTIAL), FINES, PENALTIES AND OTHER COSTS OR EXPENSES, OF ANY KIND OR NATURE, INCLUDING BUT NOT LIMITED TO REASONABLE LEGAL AND ACCOUNTING FEES (COLLECTIVELY, THE “CLAIMS”), KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES, INCLUDING, WITHOUT LIMITATION, DISPUTES ARISING OVER BREACH OF THIS AGREEMENT, BREACH OF ANY SEPARATE AGREEMENT OR TRANSACTION, AND/OR THE SUBSTITUTION OF RENTAL UNITS. FURTHER, HOST AND RENTER EACH HEREBY AGREE TO INDEMNIFY, RELEASE, DEFEND AND HOLD HARMLESS THE WETRENTALS PARTIES FROM ANY CLAIMS BROUGHT AS A RESULT OF HOST AND/OR RENTER'S (1) BREACH OF THE TERMS, (2) VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY, AND (3) USE OF THE SERVICES.
Insurance. WetRentals is not a party to any contract for insurance facilitated through any link to a third party insurance provider advertising on the Services, and is not acting on behalf of any insurer, any broker or agent, any insured or any claimant in any contract for insurance facilitated through such link. Insurance coverage may be provided through a third-party independent insurance producer not affiliated with WetRentals. WetRentals does not act as a broker, agent or consultant in the sale of insurance, is not endorsing or recommending any particular insurer or terms of coverage, and is merely providing a link for you, if you wish, to transact a contract for insurance with a third-party provider. Any contract for insurance is solely between you, as the insured, and such insurer as you and the third-party insurance provider agree shall act as the insurer. WetRentals has no control over and makes no representations regarding the coverage of any insurance you may purchase from a third-party insurance provider. You acknowledge and agree that WetRentals assumes no responsibility or liability for any claims or disputes arising from, or related to, a contract for insurance facilitated through such link. You also acknowledge and agree that WetRentals shall not be included as a party to any such claims or disputes.
2.0 Your Use of Services
Conditions of Use. As a condition of your use of the Services, you expressly represent and warrant that (i) if you will be operating a boat, you are responsible for ensuring that you are sufficiency skilled in the operation of the boat and legally authorized to operate a boat in the state or province in which you are renting and you will not allow any other occupants of the boat to operate the boat unless they are each of sufficient skill and legally authorized to operate a boat in the state or province in which you are renting; (ii) you possess the legal authority to create a binding legal obligation; (iii) you will use the Services in accordance with the Terms; (iv) you will only use the Services to post or view, as applicable, available boat rentals or transact legitimate boat rentals for you or for another person for whom you are legally authorized to act with other Users; (v) you will inform such other persons about the terms and conditions that apply to the boat rental you have made on their behalf, including all laws, regulations, rules and restrictions applicable thereto; (vi) if you are booking a rental on behalf of another person, you are individually responsible for ensuring that such other person is a party to the separate agreement for the rental of the boat; (vii) all information supplied by you to WetRentals is true, accurate, current and complete, (viii) if you have a WetRentals account, you will safeguard your account information, (ix) you are and will remain in compliance with all applicable laws, rules and regulations related to boat operation, maintenance, rental or charter, and (x) if you are listing a boat for rental, you are either (a) the owner of the boat, or (b) a representative authorized to act on behalf of the owner of the boat. You may not authorize others to use your user account, and you may not assign or otherwise transfer your user account to any other person or entity. If you reside in a jurisdiction that restricts the use of the Services because of age or restricts the ability to enter into agreements such as this one due to age, you must abide by such age limits and you must not use the Services. Without limiting the foregoing, the Services are not available to children (persons under the age of 18). By using the Services, you represent and warrant that you are at least 18 years old. WetRentals retains the right at its sole discretion to deny access to the Services to anyone at any time and for any reason, including, but not limited to, for violation of the Terms.
2.1 Sharing Contact Information
Sharing contact information such as email address, phone number, website address, company name, social media accounts or profiles, pickup locations, contact information to other Hosts, or any other form to connect directly with users outside of WetRentals is strictly prohibited. WetRentals has the sole discretion to monitor and block all content that it deems to be used to circumvent WetRentals or violates any other terms of use. Failing to abide by the terms will result in an account suspension and removal from the platform. You agree that you will not try to circumvent WetRentals by any means which includes but is not limited to conversations posted to the WetRentals messaging platform, boat listings, public and private reviews, and images uploaded.
You agree that you will only use the Services for lawful purposes.
2.2 Password Sharing
Please keep in mind that we will treat anyone who uses your user name and password as "you." We will provide this user with all of the rights and privileges that we provide to you, and we will hold you responsible for the activities of the person using your password. Therefore, we recommend that you maintain your user name and password in confidence and that you refrain from disclosing this information to anyone who might "pretend" to be you with respect to the Services. We also ask that you notify us immediately if you suspect that someone is using your user name and/or password or otherwise obtaining access to the Services in this or any other inappropriate manner.
2.3 Payment Services
While WetRentals is not a party to any agreement between you and any Host, Renter acknowledges and agrees that WetRentals may act as the Host's payment agent for the purposes of collecting payment for bookings made through the Services. Renter's provision of financial information to us for purposes of payment is governed by our Privacy Policy.
2.4 Establishing Payment Account
As a Renter, you are responsible for opening an account, providing payment authorizations for bookings and paying for Services according to these Terms, as well as others which may be included at the time of booking. You agree to provide all requested information, including a credit card to be used for pre-authorization/reserve and payment/capture for Services. Payment for a booking will be made by WetRentals directly to the Host who posted the listing.
2.5 Credit Card Information
By providing your credit card information to us, you agree that we are authorized to charge your card with the total cost of the rental, taxes and any required deposits or damages, as described below. We will run a pre-authorization for the full amount of the booking on the credit card the Renter supplies at the time of booking. You agree that we can charge a nominal amount to your credit card to verify the validity of the credit card information you provide. If the Host accepts the booking, the Renter's credit card will be charged in full for the amount previously described, although if the Host advises us of a change in delivery location following the booking and that change results in an increase in any applicable taxes we are required to charge and collect or if there is an increase in the amount to taxes imposed at the time of booking versus the date of delivery, you expressly authorize us to charge such credit card for the excess and if that card is not honoured at the time WetRentals will collect such amount from the Host and the Host will collect such amount from you before delivery of the rental to you and your failure to pay the Host for such amount may result in denial of access to the rental and forfeiture of your deposit. You expressly authorize WetRentals service provider, Stripe, to originate credit transfers to your financial institution account. WetRentals may also use a service provider to store your credit card information to facilitate payments as described herein and you expressly authorize such storage. WetRentals shall ensure that any service provider it uses to process or store your credit card information is bound by obligations to protect such information commensurate with our Privacy Policy.
2.6 Deposits
Renters are responsible for leaving the rented boat in the same condition it was in before you rented it. Renters acknowledge and agree that you are responsible for all acts and omissions of you and your guests on the boat that affect the condition of the boat. In the event a Host claims and provides evidence of damage to the boat, you agree that WetRentals shall be entitled to charge a deposit to your credit card to cover the cost of the damage, as established after reasonable investigation. This deposit may exceed the deposit set forth in the listing. We will notify you of any damage claim made by a Host related to your rental and you will have an opportunity to respond, as set forth in such notice. We will only charge a deposit to Renter's credit card after the rental is complete if the Host has made a claim and the deposit amount has been deemed appropriate after investigation of the claim. Damages will include credit card fees and any loss of use reimbursement to the host should rentals be cancelled due to damage caused by the renter.
2.7 Service Charge
We charge a service fee of 10% of the total rental to renters and 10% of the total to hosts (i.e., the booking and any additional expenses such as taxes we are required to collect) for facilitating the rental and this amount will be reflected in the final amount charged to Renter's credit card. We reserve the right to round up amounts to the nearest whole dollar (for example, $202.60 will be rounded to $203). We will process any necessary currency conversion (WetRentals charges in Canadian dollars, Australian dollars or US dollars unless otherwise specified) based upon Renter's currency on the day the credit card is charged and we will charge a conversion fee of 3% of the total rental for currency conversions. We reserve the right to adjust the conversion rate based on when the payout is made to the Host. The service fee and any conversion fee constitute "Transaction Fees." WetRentals reserves the right to adjust its Transaction Fees at any time. Any Fee changes will be effective the next time you book a rental after such fee change goes into effect (i.e., rentals already booked will be subject to Fees as established at the time of booking).
2.8 Payments to Hosts
Payment to Hosts for accepted bookings will be made net 30 days from the date of the completed reservation. Notwithstanding, in limited circumstances, on a case-by-case basis, in its sole discretion, WetRentals may elect to pay a Host a portion of the accepted booking after the reservation is made and the remaining portion of the accepted booking net 30 days from the date of the completed (fully paid) reservation. If, after Host has been paid any portion of the accepted booking by WetRentals, an accepted booking is cancelled or terminated for any reason by either Host or Renter before the reservation is completed, Hosts shall return to WetRentals all sums advanced by WetRentals for such reservation immediately (within five (5) days) upon receiving written demand for same. Host further agrees that WetRentals is not liable for any damages Host may incur as a result of such cancellation and/or having to return such funds. If Host fails to timely refund said sums, WetRentals shall also be entitled to interest on said sums at the rate of 18% per annum, or the highest rate allowed by law, whichever is lower, and all of WetRentals attorneys' fees and costs of court.
2.9 Unresponsive Hosts
If a Host does not respond to a booking inquiry, WetRentals reserves the right to transfer the booking and associated payment to another Host on Renter's behalf. WetRentals reserves the right to hold payment to Hosts if WetRentals suspects there has been fraud or other suspicious activity in connection with the rental or payment. Unacceptable payment methods that may be posted on the Services may result in the immediate removal of the non-conforming listing from the Services without notice to the Host and without refund. Unacceptable payment methods are those methods that may pose a risk of fraud, identify theft, or breach of privacy.
2.10 Substitution of Rental Units
Renter understands and acknowledges that boats/other watercraft reserved may, from time to time, be subsequently damaged or otherwise become in need of repair before the reservation is commenced. If a Host is unable to provide the reserved unit to the Renter due to it being unavailable, the Host may provide the Renter with a substitute unit that is similar in age, size, model, and value as the reserved boat/other watercraft. The Host shall provide the Renter with notice of the need for a substitution of unit(s) as soon as reasonably possible, as well as provide the Renter with pictures and a description of the substitute unit upon request. If the Host is unable to provide the Renter with a similar substitute unit (as described herein), the Renter may elect to cancel the reservation any time before it is commenced and, as its sole remedy, obtain a refund in accordance with the Refund Policy as if the Host had cancelled the reservation. The Renter shall not be entitled to any refund, and shall be obligated to pay all sums owed, if the Host offers Renter a similar unit (as described herein) and the Renter nevertheless refuses to complete and/or terminates the reservation. If there is a dispute between the Renter and the Host as to whether the substitute unit offered by the Host is sufficiently similar to the unit reserved by the Renter, WetRentals shall make the final determination, in its sole discretion, and the Renter and the Host agree to abide by WetRentals determination.
ANY DIRECT OR INDIRECT EXCHANGE OF MONEY BETWEEN RENTERS AND Hosts OTHER THAN PAYMENT THROUGH WETRENTALS IS A VIOLATION OF THESE TERMS.
2.11 Taxes
The rental/booking fee and any additional expenses may be subject to applicable local, federal, state and/or provincial taxes. Commencing with bookings made on and after date set forth after "Effective" set forth on the first page above, WetRentals will in some locations, as WetRentals phases in its tax collection and reporting system, charge and collect from the Renter all applicable taxes WetRentals is required to collect and which are imposed by a governmental authority on the rental amount and other charges that are included in the base on which such taxes are imposed and that payable by the Renter through the Services. In some jurisdictions, WetRentals may not begin collecting on the Effective date shown above or in others may not be required to collect taxes, and as provided below it is the Host's responsibility to collect and remit any such taxes imposed on the rental amount that WetRentals does not charge and collect. To the extent charged and collected from the Renter by WetRentals , the Host should not charge and collect the same amount of such taxes from the Renter. WetRentals will make the determination of the applicable amount to be charged based on the zip or postal code of the Host on file with WetRentals unless and until the Host advises WetRentals in writing of a change in the location of where the boat will be delivered to a Renter. If the change in location results in an increase in the amount of applicable taxes that should have been charged to and collected from the Renter, the Renter's credit card will be charged for such excess.
2.12 Collecting Taxes
Except to the extent provided herein or in the Host Interface Agreement, the Host accepting the booking is solely responsible for the collection, reporting, and payment of applicable taxes where those taxes are not being collected and remitted by WetRentals. WetRentals will charge applicable taxes to Renter's credit card at the time of booking and later in the event circumstances require a change. To the extent not charged and collected by WetRentals, Hosts are responsible for determining applicable taxes and should consult with your own legal/tax adviser about any tax questions in this regard. For Hosts based in the European Union, it is your responsibility to include VAT in the price of the booking and you will be responsible for reporting VAT.
2.13 Cancellation and Refund Policy
If a Host cancels an accepted rental before the rental is commenced, the Renter shall be refunded all sums paid to WetRentals for the rental, other than the Transaction Fee and any taxes WetRentals remitted to a taxing authority prior to the cancellation.
If the Renter cancels an accepted rental before the rental is commenced, WetRentals shall return to the Renter a “Cancellation Refund,” as specified below. The Transaction Fee and any applicable taxes collected by WetRentals and remitted to the taxing authority or authorities before the cancellation will not automatically be refunded to the Renter. The amount of the Cancellation Refund is determined by the Host's cancellation policy set forth in the Renter's separate rental agreement with the Host, which shall be one of the following three policies, as chosen by the Host:
Flexible
-
100% of the rental price if cancelled more than 24 hours prior to commencement of the rental; and
-
50% of the rental price if cancelled within 24 hours of commencement of the rental.
Moderate
-
100% of the rental price if cancelled more than 7 days prior to commencement of the rental;
-
75% of the rental price if cancelled less than 7 days but more than 48 hours prior to commencement of the rental; and
-
50% of the rental price if cancelled less than 48 hours but more 24 hours prior to commencement of the rental.
Strict
-
75% of the rental price if cancelled more than 7 days prior to commencement of the rental;
-
50% of the rental price if cancelled less than 7 days but more than 48 hours prior to commencement of the rental; and
-
25% of the rental price if cancelled less than 48 hours but more 24 hours prior to commencement of the rental.
2.14 WetRentals Fees
If for any reason, the Renter's separate rental agreement with the Host (a) does not contain a cancellation policy or (b) the cancellation policy therein differs from the foregoing cancellation policy options, then the amount of the Cancellation Refund will be determined in accordance with the “Strict” cancellation policy set-forth above. Renters are further subject to any additional cancellation terms set forth in the terms of each listing. To the extent the cancellation terms of a particular listing conflicts with the cancellation terms set forth herein, the cancellation terms set forth herein control.
If WetRentals issues a Cancellation Refund to the Renter that is less than 100% of the rental price, Hosts will be credited with the non-refunded portion of such rental price on the Host's next rental that is successfully completed through WetRentals.
Owner Cancellation
Transaction Fees will never be refunded. WetRentals will charge a fee for any reservation that is canceled after both parties have agreed on a booking. The following is a breakdown of cancellation fees based on the total price of the rental:
Under $100: Fee is $5 - Over $100 but below $250: Fee is $20 - Over $250: Fee is $50
The Host will be debited the cancellation fees on the next rental that is successfully completed through WetRentals or directly from the Hosts bank account. Renters are subject to the cancellation terms set forth in the terms of each listing. Additionally, if a Host cancels a rental for any reason other than weather or another circumstance affecting the safety of the Renter, such Host (rather than the Renter) will be charged the Transaction Fee for the rental, as set forth above.
2.15 Chargeback Policy
If Renter disagrees with any charges before any dispute is lodged with Renter's credit card company, Renter shall provide WetRentals with a detailed written explanation of such disputed sum within fourteen (14) days of the charge, and the parties shall engage in a discussion related to same. FAILURE TO PROVIDE TIMELY NOTICE OF SAID DISPUTE VOIDS ANY CLAIM OR DISPUTE. At WetRentals' request, Renter shall provide any additional written explanation or details and/or supporting documentation, in the format desired by WetRentals. RENTER SHALL NOT DISPUTE VALID CHARGES ASSESSED IN ACCORDANCE WITH THESE TERMS OF USE.
2.16 Payment Risk
The Host understands and acknowledges that WetRentals acts merely as a conduit for reservations and payments between Renters and Hosts, and the Host assumes all rental payment risk. IF A RENTER OBTAINS A CREDIT CARD CHARGEBACK AGAINST WETRENTALS, FOR ANY REASON, AND WETRENTALS HAS ALREADY PAID ALL OR A PORTION OF SUCH AMOUNT TO THE HOST, THEN THE HOST SHALL IMMEDIATELY (WITHIN FIVE (5) DAYS UPON RECEIVING WRITTEN DEMAND FOR THE SAME) RETURN TO WETRENTALS ALL SUCH AMOUNTS.
2.17 Use of Services
The content and information on WetRentals Services (including, but not limited to, price and availability of boats listed in any inventory database), as well as the infrastructure used to provide such content and information, is proprietary to WetRentals, its licensors, its suppliers and providers. While you may make limited copies of your booking documents (and related documents) for boat rentals booked through the Services, you agree not to and you have no right to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, content, products, or services obtained from or through the Services. Additionally, you agree not to:

use the Services or its contents for any commercial purpose without our express written permission;
-
send or store infringing, obscene, threatening, libelous, or otherwise unlawful or tortious material, including material harmful to children or violative of third-party privacy rights;
-
send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
-
interfere with or disrupt the integrity or performance of the Services or the data contained therein;
-
attempt to gain unauthorized access to the Services or its related systems or networks;
-
make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
-
access, monitor or copy any content or information of the Services using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
-
violate the restrictions in any robot exclusion headers on the Services or bypass or circumvent other measures employed to prevent or limit access to the Services;
-
take any action that imposes, or may impose, in WetRentals discretion, an unreasonable or disproportionately large load on WetRentals infrastructure;
-
deep-link to any portion of the Services (including, without limitation, the purchase path for any boat rental reservation) for any purpose without our express written permission; or
-
"frame", "mirror" or otherwise incorporate any part of the Services into any other website or service without our prior written authorization.
3.0 AGREEMENT TO ARBITRATE DISPUTES
IMPORTANT: PLEASE REVIEW THE ARBITRATION AGREEMENT SET FORTH BELOW CAREFULLY, AS IT WILL REQUIRE YOU TO RESOLVE DISPUTES WITH WETRENTALS ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION. BY ENTERING THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND HAVE TAKEN THE TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION.
By agreeing to the Terms, you agree that you are required to resolve any claim that you may have against WetRentals on an individual basis in arbitration, as set forth below. This will preclude you from bringing any class, collective, or representative action against WetRentals, and also preclude you from participating in or recovering relief under any current or future class, collective, consolidated, or representative action brought against WetRentals by someone else.
Opt-out of Agreement to Arbitrate. You can decline this agreement to arbitrate by emailing support@WetRentals.com and saying “I opt out of arbitration” in the email within 14 days of first registering your account.
3.1 Disputes
You and WetRentals agree that any dispute, claim or controversy ("Claim") arising out of or relating to this agreement between you and WetRentals, including (without limitation) Claims based on contract, tort (including intentional torts), fraud, agency, negligence, statutory or regulatory provisions or any other source of law and (except as otherwise specifically provided in this Agreement) Claims relating to the existence, breach, termination, enforcement, interpretation or validity of this agreement (including the validity of this arbitration clause), shall be settled by binding arbitration administered in the USA by the American Arbitration Association, www.adr.org, 1-800-778-7879 (the “Administrator”), in Canada by ADR Ottawa, www.adrottawa.com, (613) 565.6215 (the “Administrator”), in Australia by The Australian Centre for International Commercial Arbitration, www.acica.org.au, +61 (0) 2 9223 1099 (the “Administrator”), and not in a court of law (excluding solely non-monetary injunctive or equitable relief as provided below). The Administrator provides information about arbitration, its arbitration rules and procedures, fee schedule and claims forms on its website or by mail as set forth above. The Administrator will apply the rules and procedures in effect and applicable to the claim at the time the arbitration is filed. The Claim will be heard before a single arbitrator. The arbitration will not be consolidated with any other arbitration proceedings. The arbitrator shall not have any authority to entertain a claim or to award any relief, on behalf of or against anyone other than a named party to the arbitration proceeding. The Administrator shall resolve each dispute in accordance with applicable law. You further agree that judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
You consent to electronic service of process, with service to be made to the email address we have on record for your account.
3.2 Waiving Rights
YOU ACKNOWLEDGE AND AGREE THAT YOU AND WETRENTALS ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE AS A PLAINTIFF OR CLASS HOST IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND WETRENTALS OTHERWISE AGREE IN WRITING, ANY ARBITRATION OR OTHER LEGAL PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Notwithstanding mandatory arbitration, as provided above, you and WetRentals each retain the right to seek solely non-monetary injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.
You agree that any and all communications and evidence related to any dispute ultimately resolved by arbitration or mediation with the Administrator arising out of or relating to this agreement shall be held and will remain confidential and that you will not take any action that will harm the reputation of any of the other parties to the arbitration or mediation or WetRentals or which would reasonably be expected to lead to unwanted or unfavourable publicity to and of the parties, WetRentals or other entities involved in or incidental to the arbitration or mediation. You understand that those parties and entities include but are not limited to the claimant, respondent, witnesses, and WetRentals.
4.0 Identity Verification
User verification on the Internet is difficult and we cannot, and do not, assume any responsibility for the confirmation of each Renter or Host's purported identity. Notwithstanding the foregoing, you agree that you will provide us or the Host with whom you book a rental with whatever proof of identity we may reasonably request.
You agree to (i) keep your password and online ID for both your WetRentals account and your email account secure and strictly confidential, (ii) notify us immediately and select a new online ID and password if you believe your password for either your WetRentals account or your email account may have become known to an unauthorized person, and (iii) notify us immediately if you are contacted by anyone requesting your online ID and password. We discourage you from giving anyone access to your online ID and password for your WetRentals account and your email account. However, if you do give someone your online ID and online password, or if you fail to adequately safeguard such information, you are responsible for any and all transactions that the person performs while using your WetRentals account or your email account, even those transactions that are fraudulent or that you did not intend or want performed.
5.0 Exclusion of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND WITHOUT WARRANTY OF ANY KIND AND WETRENTALS ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, LICENSORS AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. NEITHER WETRETALS NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, LICENSORS NOR SUPPLIERS WARRANT THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE OR WITHOUT BREACHES OF SECURITY.
WETRENTALS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO RENTERS OR HOST THAT:

THE INFORMATION PROVIDED BY RENTERS OR HOSTS IS TRUE OR CORRECT,
-
BOAT RENTALS WILL BE AVAILABLE AT ADVERTISED DATES, TIMES, LOCATIONS, AND/OR PRICES, INCLUDING PURSUANT TO A CONFIRMED OR PURCHASED RESERVATION,
-
BOATS WILL BE COMPLIANT WITH ANY LEGAL OR SAFETY REQUIREMENTS,
-
YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS,
-
YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR,
-
ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, OR
-
THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO IN THESE JURISDICTIONS THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY.
6.0 Limitation of Liability
IN NO EVENT WILL WETRENTALS ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES OR AFFILIATES BE LIABLE TO RENTERS, HOSTS, OR ANY PARTY FOR:

ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE, DAMAGES ARISING OUT OF THE USE, AVAILABILITY OR UNAVAILABILITY OF THE SERVICES (INCLUDING BUT NOT LIMITED TO THE UNAVAILABILITY OR CHANGE IN ADVERTISED AND/OR PURCHASED BOAT RENTALS) OR ANY OTHER SERVICES OR GOODS OBTAINED THROUGH USE OF ANY OF THE FOREGOING, OR ANY DATA TRANSMITTED THROUGH THE SERVICE, EVEN IF WETRENTALS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND

ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF:

ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICES;

ANY CHANGES WHICH WETRENTALS MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);

YOUR FAILURE TO PROVIDE WETRENTALS WITH ACCURATE ACCOUNT INFORMATION;
-
YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.

ANY BODILY INJURY, DEATH, OR PROPERTY DAMAGE THAT MAY OCCUR AS THE RESULT OF A BOATING-RELATED ACCIDENT, THE RESERVATION FOR WHICH WAS FACILITATED USING WETRENTALS SERVICES. YOU AGREE THAT WETRENTALS IS NOT A PARTY TO ANY CONTRACT OR AGREEMENT FOR BOAT RENTALS AND IS IN NO WAY RESPONSIBLE FOR INJURIES TO PERSONS OR DAMAGE TO PROPERTY WHICH MAY OCCUR DURING OR RELATED TO A BOAT RENTAL WHETHER AS A RESULT OF THE NEGLIGENCE OF ANY RENTER, BOAT OPERATOR, OR HOST, OR THE SAFETY OF ANY BOAT OR FOR ANY OTHER REASON. YOU ACKNOWLEDGE AND AGREE THAT WETRENTALS SHALL HAVE NO LIABILITY RELATED TO YOUR BOOKING AND RENTAL OF A BOAT, AND ANY SUCH BOOKING AND/OR RENTAL IS MADE AT THE RENTER'S AND HOSTS SOLE RISK.
Notwithstanding the Terms, if WetRentals is held liable, WetRentals entire aggregate liability under or arising out of these Terms or the Services shall be limited to the greater of (a) the service fees you paid to WetRentals in connection with your use of the Services (if any), or (b) One-Hundred Dollars (US/CAD/AUD$100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so in these jurisdictions, the above limitations or exclusions may not apply.
Release and Indemnity. IN THE EVENT OF A DISPUTE BETWEEN A RENTER AND A HOST, HOST AND RENTER, JOINTLY AND SEVERALLY, HEREBY AGREE TO INDEMNIFY, RELEASE, DEFEND AND HOLD HARMLESS WETRENTALS AND ITS DIRECTORS, OFFICERS, AGENTS AND EMPLOYEES (COLLECTIVELY, THE “WETRENTALS PARTIES”) FROM ANY CLAIMS, CAUSES OF ACTION, DEMANDS, RECOVERIES, LOSSES, DAMAGES (ACTUAL AND CONSEQUENTIAL), FINES, PENALTIES AND OTHER COSTS OR EXPENSES, OF ANY KIND OR NATURE, INCLUDING BUT NOT LIMITED TO REASONABLE LEGAL AND ACCOUNTING FEES (COLLECTIVELY, THE “CLAIMS”), KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES, INCLUDING, WITHOUT LIMITATION, DISPUTES ARISING OVER BREACH OF THIS AGREEMENT, BREACH OF ANY SEPARATE AGREEMENT OR TRANSACTION, AND/OR THE SUBSTITUTION OF RENTAL UNITS. FURTHER, HOST AND RENTER EACH HEREBY AGREE TO INDEMNIFY, RELEASE, DEFEND AND HOLD HARMLESS THE WETRENTALS PARTIES FROM ANY CLAIMS BROUGHT AS A RESULT OF Host AND/OR RENTER'S (1) BREACH OF THE TERMS, (2) VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY, AND (3) USE OF THE SERVICES. USERS ALSO ACKNOWLEDGE AND AGREE THAT WETRENTALS HAS NO OBLIGATION TO MEDIATE, RESOLVE, OR ADJUDICATE DISPUTES BETWEEN USERS EXCEPT AS EXPRESSLY STATED IN THESE TERMS OF USE.
7.0 Proprietary Materials
The Services contain proprietary materials such as logos, text, software, photos, video, graphics, music and sound. WetRentals is the owner or licensee of all such proprietary material and all intellectual property rights therein, including without limitation, copyrights and trademarks. In using the Services, you agree not to upload, download, distribute, or reproduce in any way any such proprietary materials without obtaining WetRentals prior consent, except you may make limited copies of your booking documents (and related documents) for boat rentals booked through the Services.
8.0 Unsolicited Ideas and Feedback
From time to time, users submit to us ideas or suggestions pertaining to our business, such as ideas for new or improved products or technologies, website or tool enhancements, processes, materials, marketing plans or new product names. We do not solicit such ideas or suggestions and are under no obligation to review or consider them. If you choose to submit any ideas, original creative artwork, suggestions or other works ("submissions") in any form to us, then regardless of what you say, write or provide to us in connection with your submissions, the following terms shall apply. The sole purpose of this policy is to avoid potential misunderstandings or disputes in the event that any part of our business, such as our products, websites, technologies or marketing strategies, seem similar to any of your submissions.
If you provide any submissions to us, you agree that: (1) we may use or redistribute any such submission and its contents for any purpose and in any way without any compensation to you; (2) there is no obligation for us to review any submission; and (3) there is no obligation to keep any submission confidential.
9.0 No Spam, Spyware, or Spoofing
We and our Users do not tolerate spam. You may not use the Site to send spam or otherwise send content that would violate the Terms.
10.0 Links to Third-Party Websites or Services
The Services may contain links to other websites, social media platforms or other online services operated by parties other than WetRentals ("Third-Party Websites"). WetRentals links to such other Third-Party Websites is for informational purposes only and does not imply any endorsement of the products, services or material on such Third-Party Websites or any association with their sponsors or operators. You access any Third-Party Websites at your own risk. We are not responsible in any way for such Third-Party Websites or resources. We will not have any liability as a result of your use of such Third-Party Websites and resources, and your use of such sites and resources will not be governed by these Terms.
11.0 AquaShield
-
AquaShield coverage is optional and can be purchased for 15% of the total booking price.
-
AquaShield coverage applies only to superficial damages incurred during the rental period.
-
AquaShield coverage is applicable exclusively to superficial damages sustained during water-based activities.
-
AquaShield coverage does not cover intentional, willful or wear and tear damage caused by the renter.
-
The renter and hosts are responsible for reporting any damages or accidents that occur during the rental period to WetRentals within' 1 hour or as soon as phone service is obtained.
-
The WetRentals reserves the right to determine the extent of damages covered by AquaShield and to repair the damage or seek reimbursement for the cost of repairs.
-

AquaTow coverage does not include intentional, willful, or routine maintenance-related issues caused by the renter.

The renter and hosts are responsible for reporting any towing incidents or breakdowns that occur during the rental period to WetRentals within 1 hour or as soon as phone service is obtained.

WetRentals reserves the right to determine the necessity and extent of the towing services provided by AquaTow and to either dispatch a tow service or seek reimbursement for the cost of towing.

Coverage Fee: Loss of Use Coverage is optional and can be purchased for 8.5% of the total booking price.
Coverage Scope: Loss of Use Coverage covers loss of rental income due to damages caused by a renter that render the boat unusable for future rentals.
Coverage Conditions:
- The coverage applies exclusively to damages that prevent the boat from being rented out for future bookings.
- This includes damages caused during the rental period that require repairs before the boat can be rented again.
Exclusions:
- Loss of Use Coverage does not cover intentional, willful, or wear and tear damage caused by the renter.
- The policy does not cover any indirect or consequential losses, such as loss of market value or business interruption not directly related to the damage.
Reporting Damages:
- Renters and hosts must report any damages or accidents that occur during the rental period to WetRentals within 1 hour or as soon as phone service is obtained.
Damage Assessment:
- WetRentals reserves the right to determine the extent of damages covered by the Loss of Use Coverage and to decide whether to cover the loss or seek reimbursement for the cost of repairs.
Deductibles:
- The renter is responsible for any deductibles or excess fees associated with the Loss of Use Coverage. Deductibles are fixed at 1 day rental cost.
Coverage Limits:
- Loss of Use Coverage is limited to a maximum of $10,000 for loss of rental income. If the potential rental income loss is less than $10,000, the coverage amount is capped accordingly, with no deductible applied.
Additional Insurance:
- Loss of Use Coverage is not a substitute for personal liability or boat insurance. Renters are responsible for obtaining any additional insurance coverage they deem necessary.
Eligibility:
- Loss of Use Coverage is only available to renters who meet WetRentals' eligibility criteria and who agree to the terms and conditions.

- WetRentals reserves the right to modify or cancel the Loss of Use coverage at any time and without prior notice or refund.

By promoting a listing, the host acknowledges and agrees to all of the terms and conditions outlined above.
15.0 AI-Controlled Pricing
Listings with "Dynamic Pricing" are subject to AI-controlled pricing. This means that the prices may fluctuate based on various factors including demand, booking dates, and other market conditions. The AI algorithm may adjust prices upwards or downwards without prior notice to optimize rentals and revenue.
By booking a listing with AI-controlled pricing, you acknowledge and agree to the following:

Prices are subject to change at any time before you complete your booking, and the price you see at the time of booking is the price you will be charged.

Once a booking is confirmed, the price for that booking will not change.

We are not responsible for any price changes that occur after you have made a booking.

16.0 Intergalactic Use of Services:
While WetRentals is currently designed for Earth-based users only, we acknowledge the vastness of the universe and the potential for interstellar interest in our watercraft sharing platform. Therefore, the following provisions apply to non-Earth entities (hereinafter referred to as "Alien Users"):
Compliance with Earthly Laws: Alien Users agree to abide by all local, national, and international laws of Earth while using the WetRentals platform. This includes, but is not limited to, maritime laws, water safety regulations, and any galactic treaties currently unrecognized by Earth governments.
No Intergalactic Transportation: WetRentals watercraft are not equipped for space travel or operation in non-terrestrial environments. Alien Users must refrain from attempting to modify watercraft for interstellar use or transporting them beyond Earth's atmosphere.
Communication Protocols: Alien Users must ensure that all communication with WetRentals and its Earth-based users is conducted in a manner that is understandable and non-threatening to humans. Any attempts at mind control, telepathy, or other forms of extraterrestrial influence are strictly prohibited.
Cultural Sensitivity: We welcome the diversity that Alien Users might bring to the WetRentals community. However, all users are expected to respect the cultural norms and sensitivities of Earth-based users, including refraining from any behaviour considered invasive or hostile by human standards.
Insurance Coverage: Alien Users are subject to the same insurance and coverage policies as Earth-based users. However, WetRentals reserves the right to modify or deny coverage for claims arising from incidents deemed to be the result of extraterrestrial technology or influences beyond the scope of current human understanding.
17.0 Pirate Code Acknowledgment
Avast Ye, Users of WetRentals!
By agreeing to these terms, users hereby acknowledge that while navigating the briny depths or coasting along the shores in any vessel acquired through WetRentals, they may find themselves subject to the venerable and time-honoured Pirate Code. Be it known that the Pirate Code serves as a guideline rather than enforceable law, a collection of suggestions for those who choose to embrace the way of the sea rover.
While WetRentals does not endorse acts of piracy, maritime mischief, or the pursuit of buried treasure without proper historical preservation oversight, we do encourage a hearty "Arrr!" to be uttered at least once during your maritime journey. This utterance should be in the spirit of good fun and camaraderie, acknowledging the rich history of seafaring lore and legend.
Terms of the Code:

Sharing of Riches: Any treasure discovered while aboard a WetRentals craft should be reported to WetRentals' Mythical Finds Department. A finder's fee, in the form of credit towards future rentals, may be awarded.

Parley Rights: Should disputes arise amongst users or with landlubbers, the right to parley shall be respected, allowing for peaceful negotiations before any escalation. Sea Shanty Clause: All users are encouraged to learn and sing at least one sea shanty during their rental period. Lyrics should be family-friendly and celebrate the spirit of adventure and exploration.

Flag Flying: While flying the Jolly Roger is permitted, users must also display a WetRentals flag to signal participation in a community of respectful and legal sea enthusiasts. By setting sail with a WetRentals vessel, users agree to uphold the spirit of the Pirate Code, embarking on their aquatic adventures with respect for the sea, its lore, and all who navigate it.
18.0 Data Breach Notification
Notification Obligations: In the event of a data breach that compromises user personal information, payment data, or account security, WetRentals will notify affected users within seventy-two (72) hours of discovering the breach.
Method of Notification: Notifications will be sent via email to the address associated with your account and may also be posted as a notice on the WetRentals website and mobile applications.
Information Provided: Breach notifications will include, to the extent known at the time of notification: (i) the nature of the breach; (ii) the types of information that were compromised; (iii) steps WetRentals is taking to address the breach; (iv) recommended actions users should take to protect themselves; and (v) contact information for further inquiries.
Ongoing Updates: WetRentals will provide updates to affected users as additional information becomes available during the investigation and remediation process.
Third-Party Breaches: If a breach occurs at a third-party service provider (such as our payment processor), WetRentals will notify affected users as soon as we are informed by the third party and will coordinate with them to provide necessary information and support.
No Liability Limitation: This notification obligation does not limit or expand WetRentals' liability as set forth elsewhere in these Terms.
19.0 Account Termination and Data Retention
User-Initiated Account Deletion: Users may request deletion of their WetRentals account at any time by contacting support@wetrentals.com with the subject line "Account Deletion Request." WetRentals will process account deletion requests within thirty (30) days of receipt.
Data Retention Upon Deletion: Upon account deletion, WetRentals will:

Immediately disable access to your account and remove your profile from public view

Permanently delete personal information within ninety (90) days, except as required below

Retain transaction records, payment information, and communications for seven (7) years as required by applicable financial and tax regulations

WetRentals-Initiated Termination: If WetRentals terminates your account for violation of these Terms, we reserve the right to retain your information for up to ten (10) years to prevent re-registration and protect the platform.
Data Portability: Upon written request prior to account deletion, WetRentals will provide users with a copy of their personal data in a commonly used, machine-readable format within thirty (30) days.
Post-Deletion Reviews: Reviews you have written or received may remain on the platform in anonymized form after account deletion to maintain the integrity of the review system, but will no longer be associated with your name or profile.
20.0 Seasonal Operations and Partner Program
Seasonal Service Restrictions: WetRentals operates on a seasonal schedule to ensure optimal service quality and safety during peak boating months. Between October 1st and May 1st of each year, the following restrictions apply:
Login and Signup Suspension: New user registrations and standard user logins will be disabled during the off-season period (October 1st - May 1st). Existing users will not be able to access their accounts for booking or listing purposes during this time.
Partner-Only Operations: During the seasonal suspension period, WetRentals will exclusively offer bookings through our partnered platforms and distribution channels, including but not limited to:

Partner Program Access: Users who wish to maintain year-round availability should contact support@wetrentals.com to inquire about joining our Partner Program. Partner-level accounts maintain access to the platform during the off-season period.
Account Status During Off-Season: Standard user accounts will remain in good standing during the seasonal suspension. No fees, penalties, or negative consequences will result from the inability to access accounts during this period. All account data, listings, reviews, and booking history will be preserved.
Reactivation Notice: WetRentals will notify all users via email at least fourteen (14) days before the platform reopens for standard access on May 1st. Users will be able to log in and resume normal platform activities immediately upon reopening.
Seasonal Booking Considerations:

Force Majeure Exception: In extraordinary circumstances, WetRentals may extend or modify the seasonal suspension period due to safety concerns, regulatory requirements, or other force majeure events as outlined in Section 30.0.

22.0 Content Moderation and Community Standards
Prohibited Content: Users may not post, upload, or share content that:

Review Integrity: All reviews must be based on genuine experiences. WetRentals prohibits:

23.0 Dispute Resolution and Investigation Timeline
Damage Claim Investigation: When a Host submits a damage claim against a Renter, WetRentals will:
Notify the Renter within twenty-four (24) hours of receiving the claim Provide the Renter with five (5) business days to respond with their account of events and any supporting evidence Complete investigation and make a determination within fourteen (14) calendar days of receiving all necessary information from both parties
Payment Disputes: Disputes regarding charges, refunds, or payment issues will be investigated and resolved within twenty-one (21) calendar days of receiving a complete written complaint with supporting documentation. Arbitration Timeline: In cases proceeding to arbitration as outlined in Section 3.0, users can expect:

24.0 Payment Processing and Technical Failures
Payment Authorization: By providing payment information, you authorize WetRentals and its payment processor, Stripe, to charge your payment method for all applicable fees. You represent that you have the legal right to use the payment method provided. Failed Payments: If a payment fails during the booking process:

You will have twenty-four (24) hours to provide alternative payment information

25.0 Safety Standards and Equipment Requirements
Minimum Safety Equipment: All boats listed on WetRentals must be equipped with safety equipment as required by applicable federal, state/provincial, and local regulations, which may include but is not limited to:

Safety Equipment Inspection: Renters should inspect all safety equipment before departure and immediately report any missing, damaged, or expired equipment to the Host. Renters have the right to refuse a vessel that does not meet safety requirements without penalty. Weather-Related Safety:
Hosts must provide current weather forecasts and marine warnings to Renters Renters should not operate vessels in conditions beyond their skill level Either party may cancel a rental due to unsafe weather conditions as outlined in Section 18.0 (Acts of God)
Incident Reporting: Any safety incidents, accidents, near-misses, or equipment failures must be reported to WetRentals within one (1) hour or as soon as communication is available. Safety Violations: WetRentals may immediately suspend or terminate accounts of Hosts who:

No Warranty: While WetRentals requires Hosts to meet these safety standards, WetRentals makes no warranty regarding vessel safety and is not liable for safety-related incidents as set forth in Section 6.0.
26.0 Background Checks and User Verification
Identity Verification Requirement: All users must complete identity verification before completing their first booking or listing. Verification requirements include:

Right to Contest: If you believe identity verification or background check results are inaccurate, you may contest the results by contacting support@wetrentals.com with supporting documentation. WetRentals will review contested results within fourteen (14) business days. Continuous Monitoring: WetRentals may employ continuous monitoring services that alert us to changes in user background information, including new criminal convictions or regulatory actions.
Third-Party Verification Services: WetRentals uses reputable third-party services to conduct identity verification and background checks. By agreeing to these Terms, you consent to WetRentals sharing necessary information with these third parties for verification purposes.
International Users: Background check requirements and capabilities may vary by jurisdiction. International users may be subject to additional verification requirements based on their country of residence.
27.0 Emergency Contacts and Protocols

24/7 Emergency Hotline: WetRentals maintains a 24/7 emergency hotline for urgent safety matters occurring during active rentals. This line should only be used for genuine emergencies including:

Location Sharing: Users are encouraged to share their location with their emergency contact during rentals using their mobile device's location sharing features. WetRentals may also offer optional real-time location tracking for enhanced safety.
Float Plan Requirements: For rentals exceeding four (4) hours or involving overnight stays, Renters are strongly encouraged to file a float plan with their emergency contact including:

Overdue Renter Protocol: If a Renter is more than two (2) hours overdue for return without contact:

Medical Information: Users may optionally provide medical information (allergies, medications, conditions) that would be relevant in emergency situations. This information is encrypted and only accessible in confirmed emergency situations.
Emergency Expense Coverage: In genuine emergency situations requiring towing, rescue services, or emergency medical transport, expenses may be covered by optional AquaTow or other insurance products. Users are responsible for emergency expenses not covered by such products.
Privacy in Emergencies: While WetRentals respects user privacy, in genuine emergency situations involving potential harm, WetRentals reserves the right to share user information with emergency services, law enforcement, coast guard, and emergency contacts without prior consent.
False Emergency Reports: Users who knowingly make false emergency reports may be subject to account termination and may be liable for costs incurred by WetRentals and emergency services.
28.0 Geographic Restrictions and Operational Limitations
Availability in specific locations within these countries may vary. WetRentals reserves the right to expand or limit service areas at any time.
Restricted Waters: Boats listed on WetRentals may not be operated in the following areas unless specifically authorized:

Restricted military zones or naval bases

Designated marine sanctuaries or protected areas where motorized vessels are prohibited

International waters beyond 12 nautical miles from shore (unless specifically permitted by listing)

Waters where Host does not have legal authorization to operate

Cross-Border Rentals:

Renters must not take vessels across international borders without express written permission from the Host

Jurisdictional Requirements: Users must comply with all applicable boating regulations in the jurisdiction where the vessel is operated, including but not limited to:

Marine Protected Areas: Hosts must disclose if their vessels will be operating in or near marine protected areas. Renters must comply with all restrictions including:

Hurricane and Storm Restrictions: During hurricane season or when tropical storms are forecasted:

No penalties will apply for cancellations due to named storms or hurricanes

Users must follow all evacuation orders and maritime safety bulletins
Temporary Closures: WetRentals may temporarily suspend Services in specific geographic areas due to:

Natural disasters

Civil unrest or safety concerns

Public health emergencies

Government-mandated closures

Environmental hazards (red tide, algal blooms, oil spills)
Future Expansion: WetRentals may expand to additional countries and regions. Users will be notified of geographic expansion through email and platform announcements.
Geofencing Technology: WetRentals may employ geofencing technology to monitor vessel locations and alert users if vessels enter restricted areas. While this technology is provided as a courtesy, users remain solely responsible for compliance with geographic restrictions.
Offshore Distance Limitations: Unless otherwise specified in the listing:

29.0 Dormant Account Policy
Account Inactivity: An account is considered dormant if there has been no login activity for twenty-four (24) consecutive months.
Dormant Account Notifications:

Users will receive an email notification when their account has been inactive for eighteen (18) months
-
A second notification will be sent at twenty-two (22) months of inactivity
-
Final notification will be sent at twenty-four (24) months before account deactivation
Account Deactivation: After twenty-four (24) months of inactivity, WetRentals may deactivate dormant accounts. Deactivated accounts will:

No longer be accessible for login

Have public profiles removed
-
Have listings unpublished
-
Retain stored data in accordance with Section 20.0 (Data Retention)
Reactivation: Users may reactivate a deactivated account by:

Updating payment information if expired

Reviewing and accepting any updated Terms of Service
Accounts may be reactivated within three (3) years of deactivation. After three years, users must create a new account.
Stored Payment Information:

Payment information stored in dormant accounts will be deleted after thirty-six (36) months of inactivity

Users must provide new payment information upon reactivation if payment information has been deleted
-
Credit card information that expires during dormancy will be removed upon expiration
Booking Credits and Balances:

Any booking credits, promotional balances, or account credits will be forfeited if not used within twenty-four (24) months of issuance

Users will be notified ninety (90) days before credit expiration
-
Refunds due to the user that remain unclaimed for twenty-four (24) months will be retained by WetRentals unless prohibited by applicable unclaimed property laws
Pending Issues: Accounts with pending disputes, outstanding balances, or unresolved claims will not be classified as dormant until all issues are resolved.
Security Considerations: Dormant accounts may present security risks. WetRentals reserves the right to:

Require password resets upon reactivation

Implement additional security verification
-
Review account activity for suspicious patterns before reactivation
Host-Specific Dormancy: Host accounts with active listings will not be considered dormant. However, if a Host account has no login activity for twelve (12) months, all listings will be automatically unpublished and the Host will be notified.
Communication Preferences: Dormant account notifications will be sent regardless of communication preferences to ensure users are aware of pending deactivation. Users may not opt out of these critical account notifications.
Data Subject Rights: Users in jurisdictions with data protection rights (such as GDPR) may exercise their rights regardless of account dormancy status by contacting privacy@wetrentals.com.
30.0 Dispute Resolution Between Users
WetRentals Role: While WetRentals may facilitate communication and provide a platform for dispute resolution, WetRentals is not a party to disputes between Hosts and Renters and has no obligation to resolve such disputes except as expressly stated in these Terms.
Direct Resolution Required: Hosts and Renters agree to first attempt to resolve disputes directly with each other in good faith before seeking intervention from WetRentals.
Documentation: If you need WetRentals to assist with a dispute, you must provide complete documentation including:

Detailed description of the dispute

All relevant communications between parties
-
Photos, videos, or other evidence
-
Receipts, invoices, or other financial documentation
-
Names and contact information for any witnesses
Mediation: In its sole discretion, WetRentals may offer non-binding mediation services to help resolve disputes. Both parties must agree to participate in mediation, and any resolution must be mutually acceptable.
Final Decision Authority: If WetRentals agrees to make a determination regarding a dispute (such as damage claims), WetRentals' decision is final and binding unless the parties proceed to arbitration as outlined in Section 3.0.
No Guarantee of Recovery: Even if WetRentals determines that a party is entitled to payment, WetRentals does not guarantee that payment will be collected or that the obligation will be enforceable.
Legal Action: If you choose to pursue legal action against another user, you agree to do so without naming WetRentals as a party and to hold WetRentals harmless from any such action.
31.0 Assumption of Risk and Waiver
Inherent Risks of Boating: You acknowledge and agree that boating and water-based activities involve inherent risks and dangers including, but not limited to:

Drowning, serious injury, or death

Collision with other vessels, objects, or structures
-
Capsizing or sinking of vessels
-
Weather-related hazards including storms, lightning, and high winds
-
Mechanical failure of vessels or equipment

Exposure to sun, heat, cold, and marine elements

Wildlife encounters
-
Fuel fires or explosions
-
Carbon monoxide poisoning
-
Slip and fall accidents on wet surfaces
-
Hypothermia or hyperthermia
-
Loss or damage to personal property
Voluntary Assumption of Risk: BY USING THE SERVICES TO BOOK A BOAT RENTAL, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH BOATING AND WATER-BASED ACTIVITIES, WHETHER SUCH RISKS ARE KNOWN OR UNKNOWN, FORESEEABLE OR UNFORESEEABLE. You understand that these risks cannot be eliminated regardless of the care taken to avoid injuries or damages.
Waiver of Claims: To the fullest extent permitted by law, you hereby WAIVE, RELEASE, AND DISCHARGE any and all claims for injury, death, or property damage that you may have against WetRentals, its officers, directors, employees, agents, affiliates, and partners arising out of or related to your participation in boating activities facilitated through the Services, INCLUDING CLAIMS BASED ON NEGLIGENCE OF WETRENTALS OR ANY OTHER PARTY.
No Lifeguard on Duty: You acknowledge that there are no lifeguards, safety personnel, or WetRentals representatives present during your rental period and that you are solely responsible for your own safety and the safety of your guests.
Physical Fitness Representation: By booking a rental, you represent that you are physically and mentally capable of operating or being a passenger on a boat and that you have no medical conditions that would prevent safe participation in boating activities.
Minor Participants: If you are booking a rental that will involve minors (persons under 18), you represent that you are the parent or legal guardian of such minors, or have obtained proper authorization from their parents or legal guardians, and you agree to assume all risks on behalf of such minors and to indemnify WetRentals for any claims arising from their participation.
32.0 Photo and Video Release
Media Capture: You acknowledge that during your rental, you or other users may capture photos, videos, or other media that include you, your guests, or your activities.
Use of Likeness: By using the Services, you grant WetRentals a perpetual, worldwide, royalty-free license to use any photos, videos, or other media captured during rentals facilitated through our platform for marketing, promotional, and commercial purposes, including but not limited to use on our website, social media, advertising materials, and promotional campaigns.
No Compensation: You acknowledge that you will not receive any compensation for WetRentals' use of your likeness, and you waive any right to inspect or approve any finished product that incorporates your image or likeness.
Third-Party Liability: WetRentals is not responsible for how other users (Hosts or Renters) use photos or videos that include you or your guests. Any disputes regarding unauthorized use of your image by other users must be resolved directly between you and such users.
33.0 Alcohol and Substance Use Policy
Prohibited Operation Under Influence: It is strictly prohibited to operate any vessel while under the influence of alcohol, drugs, or any other substance that impairs judgment or motor skills. Renters and vessel operators must comply with all applicable laws regarding boating under the influence (BUI).
Zero Tolerance: WetRentals maintains a zero-tolerance policy for impaired operation. Violation of this policy may result in immediate termination of rental without refund, account suspension, and reporting to law enforcement.
Renter Responsibility: Renters are solely responsible for ensuring that they and all guests comply with all applicable alcohol and substance laws. This includes ensuring that any alcohol consumption by passengers is legal and does not create unsafe conditions.
Host Discretion: Hosts may prohibit alcohol or substance use on their vessels entirely. Renters must comply with any such restrictions set forth in the listing or rental agreement.
No Liability: WetRentals shall have no liability for any accidents, injuries, or damages arising from or related to the use of alcohol or substances by Renters or their guests, and Renters agree to indemnify WetRentals for any claims arising from such use.
34.0 Swimming and Water Activities
Swimming at Own Risk: If you or your guests choose to swim, snorkel, dive, or engage in other water activities during your rental, you do so entirely at your own risk.
No Supervision: WetRentals does not provide swim instruction, supervision, or lifeguards. You are solely responsible for your own safety and the safety of your guests during water activities.
Swimming Ability: You represent that you and all guests who will be swimming have adequate swimming ability and are comfortable in open water. You acknowledge that conditions in open water differ significantly from pool swimming.
Life Jacket Use: While swimming or engaging in water sports, you agree to use appropriate safety equipment including life jackets, especially for non-swimmers, weak swimmers, and children. Buddy System: WetRentals strongly recommends using the buddy system and never swimming alone during your rental.
Water Conditions: You acknowledge that water conditions can change rapidly and may include strong currents, waves, underwater hazards, marine life, pollution, and extreme temperatures. You assume all risks associated with entering the water.
35.0 Equipment and Personal Property
Loss or Damage to Personal Property: WetRentals shall have no liability for any loss, theft, or damage to personal property that you or your guests bring aboard vessels, including but not limited to electronics, jewelry, clothing, sporting equipment, and other valuables.
Secure Your Belongings: You are solely responsible for securing your personal belongings during your rental. WetRentals recommends leaving valuables at home or in secure storage.
Equipment Provided by Host: Any equipment provided by the Host (such as water toys, fishing gear, snorkeling equipment) is provided "as-is" without warranty. WetRentals makes no representations regarding the condition, safety, or suitability of such equipment.
Third-Party Equipment: If you bring or rent equipment from third parties (such as water skis, wakeboards, diving gear), you assume all risks associated with the use of such equipment and agree to indemnify WetRentals for any claims arising from your use of third-party equipment.
Lost or Damaged Host Equipment: If you lose or damage equipment provided by the Host, you may be charged for repair or replacement costs as determined by the Host and verified by WetRentals.
36.0 Medical Emergencies and Health Conditions
Disclosure of Medical Conditions: If you have any medical conditions that could affect your ability to safely participate in boating activities (including but not limited to heart conditions, seizure disorders, pregnancy, recent surgeries, or mobility limitations), you should consult with your physician before booking a rental.
No Medical Personnel: WetRentals does not provide medical personnel, and Hosts are not required to have medical training. In the event of a medical emergency, you are responsible for seeking appropriate medical care.
Medical Expenses: You are solely responsible for all medical expenses incurred during or after your rental, including emergency medical treatment, ambulance services, hospitalization, and evacuation costs. WetRentals strongly recommends maintaining adequate health insurance.
Pre-Existing Conditions: WetRentals shall have no liability for any injuries or complications arising from or related to pre-existing medical conditions, whether disclosed or undisclosed. Medication: If you require medication, you are responsible for bringing adequate supplies and storing them properly during your rental.
Contagious Illness: If you or any guests are experiencing symptoms of contagious illness, you should not participate in the rental and should cancel in accordance with the applicable cancellation policy.
37.0 Marine Life and Environmental Hazards
Wildlife Encounters: You acknowledge that you may encounter marine wildlife during your rental, including but not limited to sharks, jellyfish, stingrays, sea urchins, alligators (in certain regions), and other potentially dangerous animals. You assume all risks associated with wildlife encounters.
Do Not Disturb Wildlife: You agree not to harass, feed, or attempt to touch marine wildlife. Violation of wildlife protection laws may result in fines, criminal charges, and liability for damages.
Environmental Hazards: You acknowledge that the marine environment contains hazards including but not limited to:

Submerged rocks, reefs, and debris

Strong currents and riptides
-
Sudden weather changes
-
Water quality issues (pollution, algal blooms, bacteria)
-
Temperature extremes
-
Shallow water and sandbars
No Liability for Natural Conditions: WetRentals shall have no liability for injuries or damages arising from natural environmental conditions or wildlife encounters.
Invasive Species: In some jurisdictions, you may be required to comply with invasive species prevention measures. You are solely responsible for such compliance.
38.0 Towing and Water Sports
High-Risk Activities: If your rental includes towing activities such as water skiing, wakeboarding, tubing, or parasailing, you acknowledge that these are HIGH-RISK activities with significant potential for serious injury or death.
Additional Waiver Required: Hosts may require separate waivers for towing and water sports activities. You agree to execute any such waivers as a condition of participating in these activities. Spotter Requirement: When towing activities are taking place, there must be at least one spotter in the boat in addition to the operator to watch the person being towed.
Equipment Inspection: You are responsible for inspecting all towing equipment (ropes, handles, life jackets) before use and immediately reporting any deficiencies to the Host. Skill Level: You represent that you and any guests participating in water sports have adequate skill and experience for the activities, or that you will receive proper instruction before participating.
Speed and Operation: The vessel operator must maintain safe speeds and operate in a manner appropriate for the activity and water conditions.
Waiver for Water Sports: BY PARTICIPATING IN WATER SPORTS, YOU ASSUME ALL RISKS OF INJURY OR DEATH AND AGREE TO HOLD HARMLESS WETRENTALS AND THE HOST FROM ANY CLAIMS ARISING FROM YOUR PARTICIPATION.
39.0 Fuel and Refuelling
Fuel Policy: Fuel policies vary by listing. Some rentals include fuel, while others require the Renter to return the vessel with the same fuel level as at departure or pay for fuel consumption.
Refuelling Safety: If you are responsible for refuelling the vessel, you acknowledge the dangers of fuel handling including fire and explosion risks. You agree to follow all safety protocols including:

Turning off the engine and all electrical equipment
-
Ensuring all passengers are off the boat
-
Not smoking or using open flames
-
Preventing fuel spills
-
Properly ventilating the vessel before restarting
Fuel Spills: You are responsible for any environmental damage or fines resulting from fuel spills caused by your negligence. You agree to immediately report any fuel spills to the Host and appropriate authorities.
Wrong Fuel: If you put the wrong type of fuel in the vessel, you are responsible for all resulting damages including engine repair or replacement costs.
Fuel Costs: You acknowledge that fuel prices fluctuate and accept responsibility for fuel costs as specified in your rental agreement.
40.0 Passenger Capacity and Weight Limits
Capacity Plate Compliance: Every vessel has a maximum passenger capacity and weight limit as specified by the manufacturer and displayed on the vessel's capacity plate. YOU MUST NOT EXCEED THESE LIMITS.
Severe Penalties: Exceeding passenger or weight capacity is a serious safety violation that can result in:

Immediate termination of rental without refund

Forfeiture of all deposits
-
Liability for any resulting damages or injuries
-
Criminal penalties under applicable boating laws
-
Account termination
Dynamic Weight Consideration: Capacity limits include passengers, equipment, fuel, and supplies. You must account for all weight when determining safe loading.
Host Specifications: Some Hosts may impose capacity limits that are lower than the vessel's maximum capacity. You must comply with any limits specified in the listing.
Children Count: Children count toward passenger capacity limits regardless of age or size. Verification: The Host may count passengers before departure and refuse to allow departure if capacity limits are exceeded.
41.0 Modification and Alteration of Vessels
No Modifications: You are strictly prohibited from making any modifications, alterations, or additions to any vessel, its equipment, or its systems. This includes but is not limited to:

Installing or removing equipment
-
Modifying the engine or electrical systems
-
Drilling holes or affixing items to the vessel
-
Altering safety equipment
-
Changing or removing vessel identification or registration
Temporary Attachments: You may not attach or affix any items to the vessel using adhesives, screws, clamps, or other fastening methods without express written permission from the Host. Decorations: While minimal, non-damaging decorations may be acceptable for special events, you must obtain Host approval in advance and remove all decorations before returning the vessel.
Liability for Unauthorized Changes: You are liable for any and all costs associated with repairing or reversing any unauthorized modifications, as well as any diminution in the vessel's value.
Safety Equipment Tampering: Tampering with, removing, or disabling safety equipment is strictly prohibited and may result in criminal liability in addition to civil penalties.
42.0 Commercial Use and Subleasing Prohibition
Personal Use Only: Unless otherwise specified in the listing and approved by the Host in writing, all rentals are for personal, recreational use only.
Prohibited Commercial Activities: You may not use rented vessels for any commercial purpose including but not limited to:

Charter operations or paid excursions
-
Commercial fishing
-
Film or photography for commercial purposes (without prior written approval)
-
Advertising or promotional activities
-
Delivery or transportation services
-
Any activity for which you charge others a fee
No Subleasing: You may not sublease, rent out, or transfer your rental to any third party. You must be present on the vessel during the entire rental period unless otherwise agreed in writing by the Host.
Insurance Voidance: Commercial use of a vessel rented for personal use may void insurance coverage, exposing you to unlimited liability.
Penalties: Unauthorized commercial use will result in immediate termination of rental, forfeiture of all fees and deposits, and you will be liable for any damages or lost income to the Host resulting from your breach.
43.0 Other Terms
General Compliance with Laws. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of the Services.
Headings. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section.
Assignment. This Agreement, the Terms, the Services and any modifications thereto may not be assigned or in any way transferred by you without the prior written consent of WetRentals. WetRentals may assign this Agreement, the Terms, and any information you provide without your consent, including, without limitation, in connection with a sale of its business, assets, a merger or other similar transaction.
Governing Law. The terms of this Agreement shall be construed in accordance with the substantive laws of the province of Ontario, Canada without giving effect to the principles of conflict or choice of law of such state. The original form of this Agreement has been written in English. The parties hereto waive any statute, law, or regulation that might provide an alternative law or forum or might require this Agreement to be written in any language other than English. This Agreement expressly excludes the United Nations Convention on Contracts for the International Sale of Goods.
Choice of Forum and Venue. You hereby consent to the exclusive jurisdiction and venue of courts in Ottawa in Ontario, Canada in all disputes arising out of the Terms or relating to the use of the Service.
No Responsibility for Acts of God. WetRentals shall not be liable for any delay or failure to perform in connection with any booking, Service or in the performance of any obligation hereunder if such delay or failure is due to or in any manner caused by acts of God, rebellion, riots, hijacking, insurrection, civil commotion, strikes or labour disputes, fires, floods, laws, regulations, acts, demands or and orders of any government or agency, seizure of the boat under legal process, adverse weather conditions, inability to obtain fuel, boat damage or loss, lack of essential parts or supplies, mechanical problems, illness or incapacitation of crew Hosts, denial of operating or docking approvals, clearances or permits by a governmental authority, or any other cause which is beyond the control of WetRentals. WetRentals is hereby released by a User from any claim or demand for any direct or consequential damages arising out of failure to perform as a result of a force majeure event whether or not herein enumerated or other event referenced above.
Severability. If any provision of the Terms is found to be invalid, illegal or unenforceable by any court having competent jurisdiction, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired thereby, and the remaining valid, legal and enforceable provisions will be interpreted, to the extent possible, to achieve the purposes as originally expressed in the invalid, illegal, or unenforceable provision.
Waiver. No waiver of any of the Terms shall be deemed a waiver of any other such Terms set forth herein.
Entire Agreement. The Terms constitute the entire agreement between you and WetRentals with respect to the subject matter covered herein, including use of the Services and any subject matter therein, and supersede all previous communications, representations, understandings and agreements, either oral or written, between the parties with respect to the said subject matter.
Termination. WetRentals may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate the User's use of all or any portion of the Services if you breach the Terms, or at any time or for any reason, at the sole discretion of WetRentals.
Non-Endorsement. WetRentals does not recommend one Host over another and does not provide advice to users regarding which Host to select for the rentals. All comments or reviews posted by WetRentals users, Renters, or Hosts on our Services do not represent the views of WetRentals in any way and are not endorsed by WetRentals absent a specific written statement to the contrary.
No Relationship. You agree that no joint venture, partnership, agency or employment relationship exists between you and WetRentals as a result of this Agreement or use of the Services.
Notice of Claim. You agree that all disputes arising out of the Terms or the use of WetRentals Services shall be communicated to WetRentals in writing within thirty (30) days from the date of the incident causally related to the dispute. You hereby waive your right to any claim against WetRentals not communicated as provided by this Section.
